Cargo transshipment
Traders may trade in goods transshipped in accordance with the following provisions :
1.Tru goods specified in paragraph 2 of this Article , the other commodities are allowed to do business in a manner transshipped ; procedures transshipped through the gate in Vietnam resolve border gate customs .
2 . For goods subject to export prohibition , suspension of export of goods on the list of prohibited imports , and suspended imports of goods exported and imported under license , traders are made transshipped through Vietnam border gate after the license of the Ministry of Commerce . Where the transfer does not cross the border gate of Vietnam, traders need not apply for a license by the Ministry of Commerce .
3 . Goods transshipped through border gates Vietnam under customs supervision until they are actually exported from Vietnam .
4 . The payment method for goods under export business transfer must comply with the regulations on foreign exchange management and guidance of the State Bank of Vietnam .
5 . Transshipped goods are made on the basis of two separate contracts : purchase contract signed by Vietnam traders with traders and exporter sales contract signed by Vietnam traders to import water traders . The purchase contract can be signed before or after the contract of sale.
EXPORTS GATE TRANSFER
I. SHIPMENT FOR EXPORT done CUSTOMS PROCEDURES SUB IN GATE OUT CUSTOMS BY CUSTOMS PROCEDURES FOR GOODS EXPORT IMPORT TRADE ; handover only oversees PRODUCTS GATE TO EXPORT GOODS :
1 . The work of the Customs Sub-Departments outside the gate :
1.1 . In case of export consignments shall be exempt from actual inspection of goods :
a. Payment for export goods declaration (sheet customs declaration ) for the declarer .
b . Make a record of delivery ( 02/BBBG2006 form attached to this Decision) : 02 in
- 01 copies sent by fax to the gate Customs Sub-Departments of offices or management of CFS / bonded warehouse (hereinafter collectively referred to as gate manufacturing / warehouse )
- 01 for the customs declaration as proof when the customs declaration lines (sheet customs declaration ) switch for gate manufacturing / warehouse .
c . Track , update , store feedback from export gate / warehouse .
d . To coordinate with the export gate / warehouse for shipment tracing shipments in case the specified time not to gate manufacturing / warehouse .
dd . Make a list of export consignments shall be exempt from actual inspection ( 05/DMHMKT2006 form attached to this Decision) . 3rd weekly periodical Fax to this list for gate customs sub-department production / warehouse for inspection and comparison ( if falls on a holiday , the holiday Fax on adjacent work ) .
e . Handling of violations relating to export shipments .
1.2 . In case of export consignments to the actual inspection of goods:
After shipment customs procedures have been prescribed , Customs Branch outer gate perform the following tasks :
a. Sealing exports fact checked as prescribed .
b . Sealing Customs records include : 01 export goods declaration (sheet customs declaration ) , 01 a detailed list of goods ( if any) , delivery of goods and the customs documents for opening sealed switch to door customs export / warehouse .
c . Perform the tasks specified in point 1.1 above ( except for e ) .
1.3 . Check and compare the statistics table record of delivery ( 03BTK2006 form ) by the Department of Customs gate / warehouse fax to the fact that their unit shipments were moving gate procedures mentioned in point 1.1 and 1.2 points above . If found to be false or lack of coordination with the Department of Customs gate / warehouse to verify , clarify
2 . The work of the Department of Customs gate / warehouse :
2.1 . Receiving handover received via fax to compare with customs documents and goods . If the time limit stated on the record of delivery to the customer without any notice to the Sub- department outside of border-gate to coordinate verification and clarification .
2.2 . Check the status of sealed goods ( customs seals , seal carrier ) ; If detected seals intact goods are not recorded in writing and notify the Customs Sub-Departments outside the gate to coordinate and handling measures timely .
2.3 . If it detects signs of shipments in violation of customs laws or the Director shall consider and decide on the form , check the level of actual goods . The test results shall be notified in writing to the Sub- department outside of border-gate .
2.4 . Signed record of delivery confirmation and save ; establish the statistics table record of delivery and fax to the Customs Department as prescribed outside the gate .
2.5 . Monitoring goods until the goods actually exported .
2.6 . Where the application for adjustment of goods for export shipments are exempt from actual inspection : The customs declaration must be in writing and send them to department outside gate and gate Customs Sub-Departments of goods before they are put into port , stating the reasons for adjustment and commitment to take responsibility before law for the application for adjustment of goods . 3 . Transfer gate from CFS / Bonded export gate :
3.1 . Export goods taken from CFS , bonded out of the gate gate transfer of goods .
3.2 . Export customs procedures have been put into Customs bonded warehouse is certified to Section 27 of the export declaration ( symbol HQ/2002-XK ) certifying that the goods have been brought into the warehouse ... ( name warehouse ) .
Exports included in CFS / bonded warehouses in 01 ( a ) declaration may appear in more overseas declarations .
3.3 . Procedures for transferring goods from the warehouse gate CFS / bonded warehouse (collectively Warehouse ) out of the gate :
a. Shippers Warehouse catalog or the transfer of goods to export gate ( 03/DMHH CFS/KNQ2006 form attached to this Decision) .
b . Customs officials inspect warehouse management warehouse shipments , sealed goods , confirm shipments and perform warehouse tasks as defined in point 1.1 ( a, b , c , d ) , Section 1 above.
c . Gate Customs Sub-Departments of implementation of the provisions of paragraph 2 ( 2.1 , 2.2 , 2.4 , 2.5 , 2.7 , 2.8 ) , Section 1 of
II . EXPORT SHIPMENT TO REGISTRATION STATEMENT IN SUB OUT CUSTOMS CHECKING THE GATE BUT ACTUAL COST OF GOODS BY DEPARTMENT OF IMPLEMENTATION GATE ( applicable to goods processed , manufactured goods exports ) :
1 . The work of the Customs Sub-Departments outside the gate :
1.1 . Do customs procedures prescribed in step 1 , step 2 of the customs procedures for exports and imports trade .
1.2 . Collection of customs fees as prescribed .
1.3 . Sealing Customs records include : 02 export goods declaration , a detailed list of 02 goods ( if any) , the declarer delivered transferred to the Customs Department of the gate .
1.4 . Dealing with the case of goods exported deviations from customs declarants on the basis of record shipments by the Customs Department to export gate , signed and sealed in square Confirm make customs procedures ( box 26 on export goods declaration , form HQ2002XK ) and stamped customs procedures completed on the customs declaration as prescribed ( if any) notice in writing to the Department border-gate customs processing results .
1.5 . Subscribe shipment until receiving the goods declaration for export ( customs kept ) by the Department of Customs to return the gate .
1.6 . Keep a record of customs regulations .
2 . The work of border-gate Customs Sub-Departments of :
2.1 . To receive shipment records have been registered at the Sub- department outside the gate .
2.2 . The actual inspection of goods by decision of the Sub- department outside gate and handling test results following manner :
a. In case the test results match the actual goods with customs declarants , then :
- Record test results on 02 real goods customs declarations ;
- Signed , sealed in square Confirm customs procedures ( box 26 of the export declaration form , form HQ2002XK ) ;
- Forums Closed customs procedures on customs declarations as prescribed ;
- Customs clearance and pay 01 shipment declaration (sheet customs declaration ) to the customs declaration as prescribed .
b . Where the actual goods inspection findings goods below the declarations of the customs declaration , then :
- Record test results on 02 real customs declaration ;
- Make a written record of administrative violations : 03 copies (01 posts Customs Sub-Departments outside-of- 01 for the customs declaration , note 01 ) ;
- Signed , sealed in square Confirm customs procedures ( box 26 of the export declaration form , form HQ2002XK ) and stamped customs procedures completed on the customs declaration as prescribed ;
- Customs clearance and pay 01 shipment declaration (sheet customs declaration ) to the customs declaration as prescribed ;
- Notify the Customs Department said outer gate .
c . Where the actual goods inspection findings goods in contravention of customs declarants for the items on the list of goods banned from export , exports must be licensed , then :
- Record test results on 02 real customs declaration ;
- Making violation record : 03 copies (01 posts Customs Branch outside-of- 01 for the customs declaration , the store 01 ) ;
- Making decisions to custody pending shipment ;
- Sealing shipment records (including records and decisions mentioned above ) sent by registered mail to the Customs Department for handling outside the gate as stipulated in point II.1.4 , Section 1 , Part B above .
d . The return 01 export goods declaration (sheet Customs) and detailed lists ( if any) for the Customs Department carried out outside the gate as follows :
- If the same to the provincial , city : Sealing records , the declarer Affairs Department moved to the place of registration of customs declarations .
- If the Customs Departments of provinces and cities : Send by certified mail
IMPORTED GOODS TRANSFER GATE
When carrying out customs procedures for imported goods transfer gate , the declarer must have application for transfer gate (hereinafter referred to as the Respondent , 01/DCCK2006 form attached to this Decision ) to the Customs Department outside the gate : 02 copies . Customs Sub-Departments outside the gate receipt, inspection , registration documents and decide on the form and severity of the actual inspection of goods according to regulations as a basis for determining transfer gate procedures appropriate for each particular import shipments below .
I. IMPORT SHIPMENT FOR REGISTRATION FULL EMPLOYMENT IN CUSTOMS PROCEDURES SUB OUT CUSTOM GATES :
1 . In case of imported consignments shall be exempt from actual inspection of goods :
For import shipments was the head of the department outside gate decision as long as the goods checked and stamped customs procedures completed , after receipt of goods from the carrier or operator customs export customs declarations made to customs procedures gate Customs Sub import ( port port monitoring department / warehouse ) to take goods from customs supervision areas .
1.1 . The work of the Customs Sub-Departments outside the gate :
- Periodically 3rd week , make a list of imported consignments shall be exempt from actual inspection (form enclosed with this decision 05/DMHMKT2006 ) and fax to the Department of Customs entry gate to check and compare ( if falls on a holiday , the holiday Fax on adjacent work ) .
- Handling problems and violations related to imported consignments by Customs Branch moved back gate entry ( if any) .
1.2 . The work of the Department of Customs entry gate :
- In the window track import shipments are exempt from actual inspection cleared .
- Where there are grounds to identify shipments are exempt from actual inspection of goods and signs of violation of customs laws , leaders gate Customs Sub-Departments are allowed to decide on the form and severity of inspection conducting international cargo and checked at the gate . The test results shall be notified in writing to the Sub- department outside of border-gate .
2 . In case of import shipments to the actual inspection of goods at Customs Sub-Departments outside the gate :
2.1 . Sign customs documents at the Customs Department in addition gate :
a. Profile registered under customs regulations in step 1 , step 2 of the customs procedures for exports and imports trade .
b . Department leadership record of approval for transfer gate into the application .
c . Customs Sub-Departments outside the sealed gate customs dossier consists of : Unit 01 , 01 declarations of imported goods (sheet customs declaration ) ; 01 A detailed list of goods ( if any) , the declarer Affairs Department for forwarding to Customs entry gate to gate transfer procedures for shipment .
d . Send Form 01 certified by the Department leadership accepted for transfer gate to gate Customs Sub-Departments in with fax and save .
2.2 . The work of the Department of Customs entry gate :
a. Receiving Unit , customs documents and compare them with the shipment.
b . Sealing imported goods according to regulations.
c . Make a record of delivery and goods moving gate : 02 in
+ 01 sent immediately by fax to Customs Sub-Departments outside the gate .
+ 01 for the customs declaration as proof transport goods on customs documents accompanying road has been sealed for transfer to the Customs Sub-Departments outside the gate .
d . Provides information about the shipment note ( key items , key enterprises , suspicious shipments , prices , codes, tax rates ) for the Customs Department said outer gate .
dd . Where there are grounds to determine import shipments signs of violation of customs laws , depending on the nature and seriousness of the violation or the Director of Customs entry gate immediately decided to conduct inspection International shipments at the border. The test results shall be notified in writing to the Sub- department outside of border-gate .
e . Check and compare the statistics table record of delivery ( 03BTK2006 form ) by the Customs Department fax outside the gate to the actual shipment procedures have been recorded in the gate transfer window track . If found to be false or lack of coordination with the Customs Sub-Departments outside the gate to verify , clarify .
g . Recorded in the tracking of imported goods transfer gate according to the criteria specified in point 5 of Part A above .
h . To compare the number of customs declaration , commodity and other criteria of imported consignments shall be exempt from actual inspection cleared the list of imported goods are exempt from actual inspection by Customs Sub-Departments outside the gate fax to . Where there is a discrepancy , do not match the Customs Department in collaboration with outside gate to verify , clarify .
2.3 . Further work of the Sub- department outside gate :

II. IMPORT SHIPMENT TO REGISTRATION STATEMENT IN SUB OUT CUSTOMS CHECKING THE GATE BUT ACTUAL COST OF GOODS FOR CUSTOMS IMPORT PERFORMANCE GATE ( applicable to goods processed , manufactured goods exports ) :
1 . The work of the Customs Sub-Departments outside the gate :
1.1 . Do customs procedures prescribed in step 1 , step 2 of the customs procedures for exports and imports trade .
1.2 . Collection of customs fees as prescribed .
1.3 . Sealing Customs records include : 02 declarations of imported goods , 02 the detailed list of goods ( if any) , the declarer Affairs Department of Customs moved to enter the gate .
1.4 . Decisions on tax adjustments , tax violations processing , sign and seal the box office to confirm the completion of customs procedures ( box 38 on the import declaration of goods , samples HQ2002NK ) and seal clearance customs on customs declarations as prescribed in case the goods are deviations from customs declarants adjustment resulting amount of tax payable on the basis of customs documents by the customs Department send to gate entry ( if any) . Notice in writing to the Customs Department said gate processing results .
1.5 . Subscribe shipment until receiving the declarations of imported goods ( Customs kept ) by the Customs Department to return the entry gate .
2 . The work of the Department of Customs entry gate :
2.1 . Receipt of import shipment records have been registered at the Sub- department outside the gate .
2.2 . The actual inspection of goods by decision of the Sub- department outside gate and handle the actual test results following manner :
a. In case the test results match the actual goods with customs declarants , then :
- Record test results on 02 real customs declaration ;
- Signed , sealed in square Confirm customs procedures ( box 38 of the import declaration of goods , samples HQ2002NK ) ;
- Forums Closed customs procedures on customs declarations and pay 01 declaration (sheet customs declaration ) to the customs declaration as prescribed ;
- To return shipment records ( 01 declaration and the detailed list ( if any) ) for Sub- department outside the gate by certified mail and shipment clearance decision .
b . Where goods are the actual deviation from the opening of the declarer leads to partial shipments are not imported , then :
- Record test results on 02 real customs declaration ;
- Making violation record : 03 copies (01 posts Customs Branch outside-of- 01 for the customs declaration , the store 01 ) ;
- Out custody decision making false declarations to the number of rows , number of rows true liberation declaration .
- Sealing shipment records ( all records above ) sent by registered mail to the Customs Department for handling outside the gate prescribed for violation of the goods .
c . Where goods are the actual deviations from customs declarants adjustment leads to the payable tax amount or policy violations for both goods shipment , then :
- Record test results on 02 real customs declaration ;
- Making violation record as prescribed : 03 copies (01 posts Customs Sub-Departments outside-of- 01 for the customs declaration , the store 01 ) ;
- Sealing shipment records ( all records above ) sent by certified mail to the Department of Customs External decision gate tax adjustments , handle violations as defined in point II.1.4 , paragraph 2 , Section B above .
- Temporary detention until shipment processing results of the Customs Sub-Departments outside the gate .
